Writ-Question No-04 (Writ Part):

Farida Begum took her disabled son Redwan on a wheel-chair to Dhanmondi Government Boys’ High School, Dhaka for admission. The Headmaster politely refused to admit Redwan on the ground that in crowded school, it is not safe for Redwan to be in the class room as the students may jeer at him and in consequence, the discipline and efficiency of the school management may be affected.

Farida Begum comes to you for seeking legal remedy, if any. Do you think that there is any remedy you can seek in the High Court Division? If so, draft an application for moving the High Court Division under the relevant Article of the Constitution. (9th January, 2016).

(প্রশ্নটি বাংলায় (রীট)ঃ ফরিদা বেগম তার প্রতিবন্দী পুত্র রেদোয়ানকে হুইল চেয়ারে বসিয়ে ধানমন্ডি সরকারী বালক উচ্চ বিদ্যালয়ে ভর্তি করার উদ্দেশ্যে নিয়ে যায়। বিদ্যালয়ের প্রধান শিক্ষিকা নম্রভাবে রেদোয়ানকে বিদ্যালয়ে ভর্তি করে নিতে অস্বীকৃতি জানান। কারণ একটা জনবহুল বিদ্যালয়ের শ্রেণীকক্ষে অবস্থান করা রেদোয়ানের জন্য নিরাপদ নয়। কারণ ছাত্র/ছাত্রীরা তাকে ব্যঙ্গ বিদ্রুপ বা টিটকারী দিতে পারে এবং তার ফলে বিদ্যালয় পরিচালনার নিয়মানুবর্তিতা এবং দক্ষতার হানি ঘটবে।

ফরিদা বেগম আইনত প্রতিকার লাভের আশায় আপনার নিকট আসলেন। আপনি কি মনে করেন হাইকোর্ট বিভাগে আপনি কোন প্রতিকার পাবেন; যদি পারেন, সংবিধানের সংশ্লিষ্ট অনুচ্ছেদের অধীনে দরখাস্তের একটি খসড়া প্রস্তুত করুন হাইকোর্ট বিভাগে দাখিল করার জন্য।

Refusal letter by the respondent No. 4 to admit the petitioner’s son Redwan in his school.

Refusal dated 01.01.2020 by the respondent No. 4, the Headmaster, Dhanmondi Government High School, Dhaka to admit Redwan son of the petitioner in the said school on the ground that in a crowded school is not safe for disabled of the petitioner.

AND

IN THE MATTER OF:

Direction upon the respondent Nos. 1-5 to admit the petitioner’s son, Redwan in his school, the Dhanmondi Government Boys High School, Dhaka.

To

Mr. Justice Hasan Foez Siddique, the Hon’ble Chief Justice of Bangladesh and his Companion Justices of the said Hon’ble Court.

The humble petition of the petitioner above named most respectfully-

SHEWETH:

1. That the petitioner is a law abiding, peace loving and permanent citizen of Bangladesh. And that the addresses given in the cause title are correct.

2. That the petitioner applied to the Headmaster, Dhanmondi Government High School, Dhaka for admitting her son Redwan in the said school.

Photocopy of the said application is annexed hereto and marked as ANNEXURE ‘A’.

3. That the Headmaster, Dhanmondi Government High School, Dhaka refused to admit the petitioner’s son Redwan on the ground that he is disabled and also added that in a crowded school is not safe for Redwan.

Photocopy of the said refusing letter in writing is annexed herewith and marked as ANNEXURE ‘B’.

4. That it is submitted that by refusing to admit the son of the petitioner to the school the respondent No. 4 infringed upon the constitutional rights of the petitioner and her son Redwan.

5. That it is submitted that by refusing the petitioner’s son in his school on the lame excuse of safety of the petitioner’s disabled son Redwan in the class room and the Headmaster’s misapprehension of affecting the discipline and the efficiency of school management was false and baseless.

6. That being aggrieved by and dissatisfied with the refusal of the Headmaster of Dhanmondi Government High School and having no other alternative efficacious remedy, the petitioner begs to move this writ petition before your Lordships on the following amongst other-

GROUNDS

I. For that the refusal of the Headmaster to admit the son of the petitioner in the said School, is illegal and without any lawful authority.

II. For that the Respondent No. 4 violated the constitutional right of the petitioner and that of her disabled son Redwan by refusing to admit the petitioner’s said son in her school, the Dhamondi Government Boys High School, Dhaka.

III. For that the Respondent No. 4 illegally refused to admit the petitioner’s son in her school on lame excuse of safety of the boy in the class room and the Headmaster’s misapprehension of affecting the discipline and the efficiency of school management was false and baseless.

IV. For that other grounds will be placed before your Lordships at the time of hearing.

Wherefore, it is most humbly prayed that your Lordships would graciously be pleased to:

(a) Issue a Rule Nisi calling upon the Responderits to show cause as to why the refusal of the Headmaster Dhanmodi Government High School, Dhaka to admit the son of the petitioner should not be declared as arbitrary, illegal, void, ultra vires, without any lawful authority and having no lawful effect.

(b) And to show cause as to why they shall not be directed to admit the petitioner’s son Redwan in Dhanmondi Government Boys’ High School;

(c) After hearing the parties and perusing the cause shown, if any, make the Rule absolute;

(d) All cost of the application be allowed to the petitioner;

(e) And or pass such other or further order or orders as your Lordships may deem fit and proper.

And for this act of kindness the petitioner as in duty bound shall ever pray.

AFFIDAVIT

I, Farida Begum, wife of Masud Sarkar and daughter of Kamal Hossain and Mst: Kopila Begum, of village/of holding No.- 99/1 Free School Road, Police Station- Dhanmondi, District-Dhaka, aged about 45 years, by Faith-Muslim, by Profession/occupation- Service/Housewife, by Nationality- Bangladeshi by birth, ID No. 111222333444 do hereby solemnly affirm and say as follows :-

1. That I am petitioner in this writ petition and as such fully acquainted with the facts and circumstances of the case and as such I am competent to swear this affidavit.

2. That the statements of facts made in this petition are true to my knowledge and matters of records which I verily believe to be true and the rests are submissions before this Hon’ble Court.
